Terms of Use Bike Park™

The following conditions apply when you enter, leave or use BikePark Commuter Destination Centres.  If you do not accept these conditions you should not participate in the BikePark User Trials.

Definition:
"Booking and Payment" means any booking and payment to use any of BikePark’s services;
"Registered User Trial Participant" or “Registered Member” means any person from whom BikePark accepts a booking and payment to use BikePark facilities;
“RFID Card” is a security device provided to enable a BikePark member to enter and exit the BikePark facility.
 “Loss” means any loss, damage, cost or expense, including consequential or indirect loss, loss of profit or loss of opportunity;
“we”, “us” and “our” mean Innovatif Knowledge Pty Ltd t/a BikePark (ABN 23 092 490 545), its employees, agents, and its authorised contractors.

  1. BikePark is strictly for use by its Registered Members.  We may refuse any persons, whether or not BikePark has accepted a Booking and Payment, without any obligation to provide reasons for such refusal.
  2. Registration requires that you provide two forms of personal identification: Driver’s License; Passport; CSV License; Corporate ID with photo; Student ID; or similar verification document.
  3. Each Registered Member is issued with a valid security RFID Card that remains the property of BikePark.  You agree not to provide this RFID Card to any other person. It ensures your personal security when entering and using BikePark.  Allowing an unregistered person access may compromise your security, the security of your articles and the security of other BikePark users.
  4. BikePark records the entry and exit of each registered user.  Unauthorised use of the RFID Card may result in cancellation of user registration.
  5. You enter and use this BikePark facility at your own risk. We may refuse entry of any bicycle or person.
  6. You agree to indemnify us in respect to any claim made against us and any expenses incurred by us as a consequence of, in relation to, or in any way arising out of your use of BikePark.
  7. You will permit BikePark staff, agents and authorised contractors to move your bicycle and personal goods in the event of emergencies or in other appropriate circumstances (including moving these items to any location outside this facility), on the understanding that they have a duty to do so with reasonable care.  If we move your goods, these conditions continue to apply. We are not liable for any damage caused to your bicycle and your personal goods when we move these items.
  8. You will only place your bicycle and other personal goods in the spaces allocated and will recognise BikePark’s right to re-allocate spaces as required.
  9. We are not liable to you or any person with you for;
    1. Injury to you or anybody else;
    2. Damage to, destruction of, theft of or unauthorised delivery of your bicycle or any other personal goods whether authorised or not; or
    3. Damage to, destruction of, theft of or delivery of any property (including anything in or on your bicycle or in your locker); however caused and you release and indemnify us from any claim, which you might have against us.
  10. We will not be liable to you, should any person take your bicycle or personal goods without your authority.
  11. We will only release your bicycle and personal goods if we are convinced that the person we are releasing them to has valid evidence of ownership or an entitlement to receive these items. If we release your bicycle and any personal goods to anyone in accordance with this clause, we will not be liable even if, the person taking these items is eventually found not to have your authority.
  12. We have a general lien and a legal claim, with the right to retain your bicycle and your personal goods as a security for any money, which you owe us.
  13. If you fail to pay us we may sell or dispose of your items after 30 days to recover any money owed to us by you.  In selling we may proceed in such a manner as we think fit in our absolute discretion and we are not obliged to obtain the best price.
  14. You agree:
    1. Not to park where we designate or indicate to you as a “No Parking” or “Reserved” area;
    2. Not to cause any obstruction or inconvenience; and
    3. Not to use this BikePark facility other than in accordance with instructions we may give.
  15. No employee, agent or contractor of BikePark has authority to accept any goods for safe custody.  BikePark will not be liable in any case for any loss of or damage to any article alleged to have been left with any BikePark employee, agent or contractor for safe custody regardless of how that loss or damage is caused.
  16. BikePark may vary these Conditions by adding, altering or deleting any of them and in that event, the new Conditions will be binding on the BikePark Registered Member when the notice of alteration is displayed or when BikePark has given one (1) weeks notice in writing of the new Conditions.
  17. No time or other indulgences granted by BikePark to Registered Members will constitute a waiver of any of its rights under this Agreement or at law and BikePark will not be precluded from exercising any such rights.
  18. If any of these conditions are illegal or unenforceable, the offending part is to be disregarded and does not affect the remaining part.
  19. Each exclusion of our liability in these conditions is subject to any Australian law, which restricts or forbids that exclusion of liability including the Trades Practices Act and similar State legislation.
